PAYMENTS AND REFUNDS
When commission is accepted, client is given a date on when their invoice will be sent out. I only work on a few pieces at a time, and only take payment once I am ready to start on a piece. Once I begin working, updates are sent every few days for approval until the final piece is delivered. I do not give firm deadlines, though a typical commission is completed within 2-3 weeks.
Once accepted, commissioner has the choice to pay in full, or negotiate a partial payment plan. Once I begin working on a commission there will be no FULL refunds, this is my job and time lost will be compensated accordingly.
If the commissioner fails to pay in any manner, I hold the right to alter and resell the art at my discretion. The commissioner, however, will be informed ahead of time of this action, so they may correct nonpayment.
No rights to characters in use will be sold and credits will still be given as to ownership of the characters.
CHANGES TO ART DURING THE COMMISSION PROCESS
The first update a commissioner receives will be a few thumbnail sketches based on the references and ideas provided in the application. After client approves a thumbnail, a blocked-out color sketch of the illustration. Please note, at this point in time items such as fur patterns, special markings or any jewelry will not be in the picture. These get added in when I work on the perfecting touches, if they are clearly labeled and on display in the ref images provided, they will be visible in the final version. In the event any articles featured in the provided reference images are absent, corrections may be made.
When a WIP is sent out for review, input from the commissioner is welcomed. Any MAJOR changes that would affect the composition of the piece, such as positioning or pose of the subjects, MUST be brought up during the initial sketch phase only. Once the colored sketch is sent, only minor changes will be considered. I reserve the right to decide final limb positioning and placement in order to preserve the composition of the piece. By default, I do not watermark the final product, client may request one to be added if desired.
COMMUNICATION
You have the right to contact me at any time with any inquiries about a commission. I make a large effort to keep the commissioner updated on their illustration, including alerting the client of any delays in production or communication. I ask that you Please make an effort to respond to emails about commissions promptly. If you do not reply to me with how you feel about progress, I cannot continue in a prompt manner myself. Commissioners that take extended periods to reply to these progress emails, will be moved to the bottom of the commission queue, to allow me to work on other art.
RIGHTS OF USE
The commissioner retains all rights to characters of their own creation used within the commissioned work. A lower resolution image will be provided alongside the full-resolution image, which is for non-commercial use with no obligation to give credit. The commissioner may be asked to delay posting the finished product publicly for up to a week after completion, during which time private sharing among friends is fine. Client may; crop, add text or use their image for personal websites at their discretion.
This is a personal piece of art, not a commercial commission, as such client waives any claim to rights of the piece. The right to reprint the art is NOT part of these rights, this includes but is not limited to: Artwork prints, book covers, game books, CD covers.
I retain the right to repost the art on any social platform as I see fit. This includes, but is not limited to, a personal portfolio or promotional example for future commissioners. Samples of your commission or cropped teaser images of the work in progress may be posted to social media for promotional purposes.
Unless agreed upon, no physical prints will be made of commissioned art. If agreed on, the commissioner can request a number of prints be given to them, at the cost of shipping. Only a limited run of prints would be made of commissioned work.
My art may not be used for NFT minting or any Blockchain implements, and is explicitly forbidden from being used in any way for the training of AI or ML.
CONTENT I WILL NOT DRAW
I will not draw minors, or underage looking characters in adult situations. No exceptions.
Given the often-realistic nature of my style, any requested and referenced genitalia may be omitted at my discretion. Note, fully natural or photorealistic animal genitalia of any kind will not be accepted under any circumstance and if a reference image is sent, I reserve the right to reject commission.
CONSENT
By accepting my Terms of service, you agree that the owners of all characters portraited have consented to the usage of their characters in the manner described by the commissioner. In the event any party other than the commissioner speaks to the contrary once the finalized piece is published, artist is waived of any liability or obligation to answer for or resolve any such claim.
